摘要
TPP投资章节中第12.5条有关最惠国待遇的内容,在继承了美国2012BITs的相关内容上又有所创新,特别是将最惠国待遇的适用排除在投资争端解决程序之外,是亮点所在。第12.5条的内容设计反映着当前国际投资条约中最惠国待遇条款发展的方向,在鼓励投资和维护东道国经济安全之间进行了很好的平衡,值得中国深入研究和借鉴。
Most-Favored-Nation Treatment in investment TPP Investment Section is set in article 12.5 and article 12.9. They are influenced by USA2012BITs while got new changes. The obvious one is that MFN is excluded from the dispute resolution procedures or mechanisms. So the articles of MFN in TPP Investment Section make balance between the investments and the host country, and China should pay close attention to the negotiation of TPP.
