摘要
范应铃是南宋一位深明法理又不失人情的判官。他长期在地方任职,深知民间疾苦,同时他深受儒学思想的熏陶,儒家伦理纲常的观念对他影响极深,故他在判案过程中特别注重法、理与情3者的结合。在《名公书判清明集》中,范应铃的判词直观反映了他重视法理、人情和同情弱者的法律思想。
Fan Yingling was a judge in Southern Song Dynasty with a deep understanding of law and human kindness.He served in the local area and clearly known the people＇s suffering.At the same time,the Confucian ethics have a profound effect on him.He paid special attention to the combination of law,respect and kindness in the process of deciding a case.In Ming Gong Shu Pan Qing Ming Ji,the court verdicts of Fan Yingling reflect his legal thought of attaching importance to legal principles,human kindness and sympathy for the weak.
