摘要
农民土地财产权利保护,关系着农民的切实利益,关系到粮食安全、耕地保护及农业生产发展。借鉴巴西、俄罗斯、印度、南非在农民土地财产权利保护中的经验和教训,立足于我国国情,做好我国农民的土地财产权利保护工作,需要对农村土地财产权进行法律规范与细化,稳定农村土地的使用权,让征地回归市场,加强地籍管理以及借助税收来加强农民土地财产权利的保护。
Farmers5 land property rights protection is closely related to farmers5 own benefits,food safety, farmland protection and agricultural development. Learning from experiences andlessons of farmers’ land property rights protection in Brazil, Russia, India and South Africa, thepaper puts forward to improve law standardization and refinement in farmers5 land property rightsprotection after taking the national condition into consideration. Land use rights should be stabilizedand land expropriation should be marketized. We should also strengthen cadastral management andfarmers5 land property rights protection by using taxation measures.
