摘要
生态文明建设是一项重要且复杂的工程,需要法制强有力的保障。在民族地区生态文明建设过程中,法制有利于生态文明建设理念制度化、长期化和保障少数民族群众生态权益,但也存在着生态文明立法不健全、生态环境执法不力、司法介入存在制度缺失等一系列问题。在总结一些民族地区生态文明建设法制保障经验的基础上,提出完善民族地区生态文明建设法制路径的构想:建立和完善生态文明法律体系,加强生态文明执法力度,健全司法机制,进而有力保障民族地区生态文明建设的顺利推进。
The construction of ecological civilization is an important and complicated project,which requires a powerful legal guarantee. In the process of ecological civilization construction in minority areas,the legal system is conducive to the construction of ecological civilization and it can protect the ecological rights and interests of the ethnic groups. But there also exist some problems,namely,imperfect legislation of ecological civilization,ineffective law enforcement of ecological environment,and inefficient judicial intervention. On the basis of summarizing the experience of the construction of ecological civilization construction in some minority areas,the author puts forward the ideas of improving the legal system of ecological civilization construction in minority areas： to establish and perfect the legal system of ecological civilization,to strengthen law enforcement of ecological civilization,and to better judicial mechanism;thus it effectively ensures the smooth progress of the construction of ecological civilization in minority areas.
