摘要
社会参与是未成年人刑事司法规律、"教育、感化、挽救"方针及社会治理创新的需要。社会参与实质上是社会力量参与,其主体包括群团组织、企事业单位、民办非企业单位、公益组织及志愿者等。社会力量在合适成年人在场、社会调查、观护帮教、附条件不起诉考察、禁止令的执行及对少年犯的社区矫正等方面可以对司法活动进行辅助与支持。为了实现社会参与的有序性和常态化,应建立有序参与和常态参与的保障机制。有序参与的保障机制包括由检察院推进社会参与、建立信息共享和转介机制以及制定有序参与的程序规范。常态参与的保障机制包括建立多部门协同工作机制、将未成年人刑事司法与社会工作进行整合以及由政府购买社会组织的服务。
It is held that social participation of juvenile criminal judicature conform to the guidelines of education,reformatory and redemption as well as can satisfy the needs of social governance innovation. In effect,social participation is participation by social powers including mass groups,enterprises and public institutions,non- governmental and non- enterprise organizations,charitable organizations and volunteers.Social powers can assist and support judicature activities in such aspects as proper presence of adults,social investigation,guardians and assistance,supervision on conditional non- prosecution,enforcement of injunction and juvenile community correction. In order to accomplish an orderly and normalized social participation,the safeguard mechanisms for orderly participation and normalized participation should be established. The former mechanism includes impetus by procutorates for social participation,information sharing,transferring mechanism and formation of procedural norms on orderly participation. The latter mechanism includes the coordination mechanism of multi sectors,integration of juvenile criminal judicature and social work,and social organization＇s service purchased by government.
