摘要
中国海警作为我国海上综合执法力量和准军事力量,相应地也应当享有海上综合执法权和准军事权。就中国海警享有海上综合执法权而言,其应当纳入法治的轨道,将权力关进"法律"的笼子,从而做到"师出有名",执法有据。
As part of comprehensive administrative enforcement at sea and as paramilitary forces,China Coast Guard is also entitled to comprehensive administrative enforcement at sea and to paramilitary power. As far as its power of comprehensive administrative enforcement at sea is concerned,it should be in accordance with the rule of law and governed by law accordingly.
