摘要
我国专利确权机制的完善已经成为实施创新驱动发展战略和国家知识产权战略的重要支撑。现行专利确权机制运行的低效率导致了诸多的利益冲突,促使我国专利法的历次修改都将完善我国现行专利确权机制作为重要内容。通过对我国现行专利确权机制相关变革方案以及国际专利确权机制的发展趋势予以分析,在此基础上提出了完善建议,以期为我国专利确权的理论研究和机制完善提供新的视角和参考。
The improvement of the patent confirmation mechanism has become an important support for implementing innovation-driven development strategy and national intellectual property strategy. The patent confirmation mechanism nowadays causes many more interests conflicts for its low efficiency, for which the improvement of confirmation of patent mechanism was deemed to important content during the past several amendments of the Patent Law in China. This paper analyzes the reformation schemes related to patent confirmation mechanism and development tendency of the international patent confirmation mechanism and puts forward some suggestions on this basis in order to bring a new view and reference to theoretical research of our country＇s confirmation of patent.
