摘要
行政处罚作为一种最严厉的制裁性行政行为,其自由裁量权若被滥用必将严重影响我国的法制建设。本文从卫生行政处罚自由裁量权的定义和表现形式入手,列举自由裁量权滥用的种种弊端,最后抛砖引玉,提出相应的控制措施,以期让卫生行政处罚的自由裁量在合理合法的轨道内进行。
Administrative penalty,as the most severe sanction in administration,would have profound impact on the construction of China legal system if the discretion right is abused.Starting from the definitions and forms of healthy administrative penalty discretion,this essay listed the drawbacks of discretion abuse and proposed appropriate controlling measures,to make sure discretion healthy administrative penalty within reasonable and legitimate tracks.
