摘要
哈尼族传统村规民约作为哈尼族传统文化的一部分,它是介于法律与道德之间具有一定权威性的民间行为规范,是正式制度与非正式制度之间的一种"准法"规定。它不仅在调节哈尼族主体行为规范、维持哈尼族社会秩序发挥着重要的作用,而且在梯田的保护中展现出不一样的功能,它通过对梯田系统中核心要素的保护来实现梯田生态系统的正常运转。随着市场经济的不断深入,哈尼族主体对生计方式的选择更加多元,单一的梯田耕种已经不能满足哈尼族主体的发展需求,梯田在哈尼族社会日渐失去重要性,梯田生态系统不断遭到破坏,梯田保护不仅仅需要资金扶持,更需要哈尼族传统村规民约的行为文化支撑。
Hani Traditional village rules and customs as a part of the traditional culture of Hani nationality, it is somewhere between law and morality with folk norm of a certain authority, between the formal system and informal system, a kind of ＂quasi law＂ stipulates. It not only in the behavior standards to regulate the subject of the Hani nationality, maintain the Hani social order plays a important role, and in the protection of terrace to show a different function, it is through the terrace system in the core elements of the protection of the normal operation of the terrace ecosystem to achieve. With the deepening of the market economy, more diverse Hani subject choice of means of livelihood, single terraced farming has been unable to meet the development needs of the Hani main terrace in Hani society has gradually lost its importance, the terrace ecosystem destruction, protection of terraced field not only need capital to support, need more behavior culture of Hani Traditional village rules and customs support.
