摘要
改革开放以来,立法与改革决策的关系历经变化,立法经历了从"确认改革成果"到"服务改革大局"再到"引领改革发展"的角色转变,与这一变化相适应,立法理念也从经验主义转向了工具主义,继而选择法治主义。在全面推进依法治国的背景下,立法角色和理念的转型也要求重塑立法与改革决策的关系,这就是以法治主义引领立法理念转变,以法治思维和法治方式协调立法与改革决策的关系,实现二者的良性互动与有效衔接。
Since the reform and opening policy,the relationship between legislation and reform policy-making has come through great changes,i.e.the legislation＇s role has shifted from ＂confirming reform achievements＂ to ＂serving the big picture of reform＂ and to ＂leading reform and development＂,correspondingly,the idea of legislation has also shifted from empiricism to instrumentalism,and then to rule of law.Under the background of comprehensively promoting rule of law,the transformation of legislation＇s role and concepts also requires reshaping the relationship between legislation and reforming poling-making,which means leading the shifts of rule of law concept through the rule of law,and coordinating relationship of legislation and reforming policy-making through the thinking and means of rule of law,to achieve the positive interaction and effective connection of the two.
