摘要
在刑事诉讼过程中,专家辅助人是刑事控辩双方利益博弈,促进法庭严查案件事实,准确把握案件性质,最终形成公正合理的裁判结果的重要参与人。基于此,通过对刑事诉讼中专家辅助人制度基本概念的辨析,对当前法律就刑事诉讼中专家辅助人制度的立法规定及有关问题进行梳理,从规范刑事诉讼中专家辅助人资格选任,明确刑事诉讼中专家辅助人的权利与义务,确立刑事诉讼中专家辅助人诉讼参与程序,完善刑事诉讼中专家辅助人诉讼结果责任承担等方面提出了完善刑事诉讼中专家辅助人制度的应对之策。
Auxiliary expert is one of the main participants in the process of criminal suit, which plays important role in balancing the benefit game between the accuser and the defender, finding out the truth and forming a fair and reasonable judgment results eventually. In this situation, the present paper firstly analyzes the concept of the auxiliary expert system, then sorts out the current legislation and problems about auxiliary expert system in criminal suit. Based on the above analysis, this paper puts forward some countermeasures to improve the auxiliary expert system from perspective of specification elected proceedings about the auxiliary expert, clarifies the rights and obligations of auxiliary expert, establishes the participation procedures of the auxiliary expert, and improves the responsibility system of the judgment results about the auxiliary in criminal suit.
