摘要
在我国,征地引发的社会问题十分突出,合法征收与限制甚至无视农地所有权人和使用权人自主意思的非法征收混杂。对于客观存在的强烈用地需求宜疏不宜堵,以尊重土地权利人的意思为基准,才能根本解决现有的矛盾。一方面,在因公益征收而发生的物权变动中,应废弃对权利人意思的不合理限制,增强被征收人在补偿事项上的平等协商权利,使征收补偿回归私法性质;另一方面,非因公益征收而发生的物权变动,应完全由当事人自主协商、依法律行为(合同)决定交易,禁止动用征收手段,这需要建立健全非公益性的土地物权变动制度。
In China, social problems initiated by land expropriation are critical. Legitimate land expropriation and limitation is inextricably commingled with illegitimate land expropriation, which ignores autonomous intention of land owners and holders. It is proper to solve the problem of intense demands for land using rather than to restraint the demands. Only based on respecting the intention of the land owners and holders, can the existing problem be resolved. On one hand, in alteration of real fight due to land expropriation of public interest, it is necessary to abandon unreasonable restraints to intentions of obligee, strengthen the negotiation on the issue of compensation, so that land expropriation return to the nature of private law. On the other hand, other alteration of real fight shall be negotiated completely by the parties and be of no expropriation process, in which non-public-interest alteration system of real right shall be established.
