摘要
事先通知义务是国际环境法上的一个重要内容。在乌拉圭河纸浆厂案中,国际法院就这一焦点问题进行了深入解析。同时,在众多国际条约中,事先通知义务均有体现。我国作为跨国河流众多的国家,为了更好地合理利用并保护跨国水资源,应注重研究相关的国际实践,特别是研究国际法院的判决,因此应尊重和研究"事先通知"等具有习惯法地位的国际规则。
Prior notification obligation is an important part of international environmental law. In the Uruguay River pulp mill case, ICJ made deep analysis on this matter. The obligation of prior notification is reflected in a number of international treaties. Owning a large number of cross-border rivers, China, in order to use and protect its transboundary water resources more reasonably, should focus on the research of relevant international practice, especially on the ICJ decision, and therefore should res^ct and analyze the international rules such as ＂prior notification＂ which serves as common law.
