摘要
我国农村在城镇化过程中遭遇了严重的生态危机和环境污染,这其中有发展理念错位的原因,但制度性成因使农村生态环境保护缺乏法律支撑。我国立法政策长期忽略农村生态环境保护法制建设,农村地区缺乏专门的环境保护机构。政府受限于人力财力难以监测、预防农村生态环境违法行为,而农民在影响农村生态环境的事务上往往没有权利参与。我国要针对农村生态环境问题制定专门立法,赋权农民参与农村生态环境保护,并尝试建立跨区域的环境管理机构,建立辅助性的非政府环境监管机制。
Our country has suffered serious ecological crisis and environmental pollution in the process of urbanization,which the reason is the dislocation development idea,but institutional cause is the lack of legal support for rural ecological environment protection. Legislation policy in China long ignored legal system construction of ecological environment protection in rural areas,and rural areas are lack of environmental protection special organization. The government is difficult to monitor,prevent the rural ecological environmental violations restricted to the manpower and financial resources,but farmers often have no right to participate in the affairs which influence the rural ecological environment. Our country should make special legislation for the rural ecological environment problems,empower farmers＇ right of participation in rural ecological environment protection,and try to establish the environmental management organization across the region,establish adjuvant nongovernmental environmental supervision mechanism.
