摘要
刑法对非公有制经济的歧视性规定,背离了刑法基本原则,已经成为严重制约经济发展的桎梏。认真研读法律文本,并对其现实问题予以正视和解决势成必然。当前,需要确立经济主体平等对待的思想,从理念和制度的角度对所有制歧视现象进行综合审视,并在此基础上,系统性地构建经济主体平等对待的制度体系。
The discrimination of non - public ownership in the criminal law is a departure from the basic prin- ciples of criminal law, which has become a serious constraint on economic development. Therefore, it is necessary to study legal texts carefully, attach importance and give resolutions to these problems. Currently, we need to es- tablish the idea of equal treatment of economic entities, and to examine the status quo of discrimination from the perspectives of the concept and institution. On this basis, we finish the systematic construction about equal treat- ment for all economic entities.
