摘要
合适成年人制度是基于儿童最大利益原则和国家亲权理论而设立的保护未成年人合法权益的一种特殊的刑事司法制度,充分体现了正当程序和双向保护原则。合适成年人制度在我国虽然是个舶来品,但其与我国传统文化理念和现实国情相契合,我国已经具备了实施合适成年人制度的法理基础。而要使合适成年人制度真正融入我国的司法体系,发挥应有的作用,必须结合我国国情进行制度构建,完善配套措施。
The the system of appropriating to adults is a special kind of criminal judicial system establlshed to protect the minor＇s legitimate rights and interests.It is based on the principle of the best protection of the interests of children,and the country＇s paternity theory, fury embodying the due process and the principle of dual protection.Although the system of appropriating to adults in our country is an exotic,but it fits the ideas of our traditional culture and realistic national conditions.China already has a legal basis to implement the system of appropriating adults.To make the system of appropriating adults truly integrate into our system of justice and play its due role, we must combine the national conditions of our country to build the system and improve supporting
