摘要
我国传统调解模式为调解员主导型调解模式。其基本特征为调解员的主动介入,主动调查纠纷事实并主动提供纠纷解决方案,调解员与当事人之间关系的基本结构为主体——客体关系。随着我国市场经济的纵深发展和法治社会的快速推进,在有限适用调解员主导型调解模式的基础上,有必要引入调解员辅助型调解模式,以便切实满足社会转型期经济社会发展的客观需求。
Our traditional mediation model is mediator - led mediation, of which the basic characteristics are the follows ： the mediator＇ s initiative intervention; the mediator＇ s active fact -finding and initiative dispute resolution -providing; the basic structure of the relationship between the mediatbr and the parties being the subject - object relationship. With the rapid development both in scope and depth of the market economy and the society of rule of law in the social transition period, on the basis of the limited application of mediator - led mediation model, it＇ s necessary to introduce a mediator - assisted mediation model, in order to effectively meet the objective demand of economic and social development in social transition of our country.
