摘要
以苹果公司为中心引发的智能手机相关专利侵权案以及以华为、中兴为中心引发的通信领域的交互专利侵权调查显示了高新技术企业竞争焦点和创新态势在发生巨大的变革。当前高技术企业行为呈现为立足于产业生态体系的竞争行为、打破行业规则的顶级创新行为以及高新技术被过度产权化行为等。这也引发了以知识为标的的交易风险、高额的技术研发费用投入引发的技术选择和产品转换风险以及高新技术产业技术标准被钳制和潜在被锁定等风险。为此,高新技术行业应从产权制度创新、共性技术建设以及产业技术网络治理角度加强行业规制。
The investigations of the smartphone-related patent infringement cases triggered by Ap- ple lnc as well as the mutual patent infringement cases in the communication industry triggered by Huawei and ZTE reveals that the competition focus and innovation trend in the high-tech enterprises are experiencing a huge change. Currently, the high-tech enterprises present such behaviors as the competitive behavior based on industrial ecology system, the top-level innovative behavior breaking the industrial rules, and the behavior of excessive property rights from high technologies. These behaviors lead to such risks as the transaction risk with knowledge as the object, the risks of technology selec- tion and product conversion triggered by large amount investment in R ＆ D, and the risks of the technical standards for the high-tech industry being clamped or potentially locked. Therefore, the high-tech industry should strengthen the industry regulation from such aspects as innovating the property right system, developing the commonly-used technologies and governing the industrial technology network.
