摘要
在数字资源采访中,图书馆所面临的著作权风险主要有合同风险与侵权风险两大类。合同风险包括主体是否适格、标的是否合法、许可范围是否清楚等;侵权风险分为直接侵权与间接侵权。图书馆规避图书馆数字资源采访中的著作权风险应从加大审查合同力度、强化注意义务与告知义务、提升馆员法律意识及充分利用版权免责条款等方面着手。
In the digital resource acquisition, the library mainly faces two categories of copyright risks： the contract risk and the infringement risk. The contract risk includes whether the contract subject is competent, the contract object is legal and the contract scope is clear or not, and so on. The infringement risk could be divided into the direct infringement and the indirect infringement. To avoid the copyright risk of the digital resource acquisition, the library should increase the power to examine the contract, strengthen the duty of the care and the disclosure, improve the legal consciousness of the librarian and make full use of the copyright exemption clause.
