摘要
政府法律人格理论的提出 ,是人类社会近现代法治文明的产物 ,其内涵是指政府应是权力和责任的统一体 ,它包含有限政府、责任政府、人道政府、国家与政府相分离等逻辑性法治命题。政府法律人格理论的实质是对行政权力实施有效的法律控制 ,其核心内容和精神要旨是建立法治政府。政府法律人格构建对西部开发具有法制投资、营造良好法治环境、创建有效政府。
The personality of government law refers to the supposition that the government should be the entity of power and responsibitity,including such logical,legal propositions as the limited government,responsibility government,humanity government,separation of the state from the goverment,etc..The theory of the government law personality is in essense meant to exercise and effective legal control over the adminstrative power;its core of the content and the gist of the spirit are to establish a government under rule by law.The construction of the personality of government law is of distinctive significance to the development in the Western Regions.
