摘要
我国在引进外资的过程中 ,国有无形资产流失严重。其成因和流失渠道是多方面的。对此 ,应采取以下防范措施 :转变立法指导思想 ,高度重视国有无形资产的价值和立法 ;加强和完善引进外资中国有无形资产管理保护的专门立法 ;实现法律的系统化和完备化 ;加快国有无形资产评估的中介机构的建设 ;健全国有无形资产产权管理体制 ;完善外商投资企业的组织机构 ;严厉打击导致国有无形资产流失的违法犯罪活动。
Heavy loss of national intangible property exists in our country's introduction of foreign capital for various reasons. Therefore, following countermeasures should be taken against it: change the guiding thought of legislation and lay stress on the value and legislation of national intangible property; strengthen and perfect the special legislation of the management and protection of national intangible property in the introduction of foreign capital; carry out the systemization and completion of law; speed up the construction of intermediary institutions for evaluing national intangible property; perfect the managerial system of property right of national intangible property; perfect the organizational institutions of foreign-investment enterprises; take strong measures against illegal and criminal activities which lead to the loss of national intangible property.
