摘要
The contractual operation right of rural land is a very important civil right with specific Chinese socialist features.The paper considers that the main problems of the contractual operation right are the legal deficiency of its real right system and the real right legal deficiency of its content,force and changes on the basis of the study on the distinctions between the real right standards of the contractual operation right and the credit right standards of that.The author argues that the countermeasure should be the real-rightize of the contractural operation right so that it becomes a new type of benefited real right which has a real right character according to the law.
