摘要
BOT是一种新兴的投资方式。本文通过对这种投资方式法律特征及法律性质的介绍和分析 ,指出了外商在我国利用 BOT投资方式的各种法律障碍。最后 ,针对我国 BOT法律制度的现状提出了几点立法建议 ,以期我国 BOT项目的实施能走上健康。
BOT is a newly rising investment pattern.This paper points out that various legislative obstacles in BOT usage in our country by the introduction and analysis of its legal features and nature. In the end,it gives several legislation suggestions to counter the current situation of BOT law system so as to help the implementing of BOT project take healthily,rapidly developing road.
