摘要
隐私权是自然人所享有的一项独立的人格权。随着社会的发展 ,它已成为自然人的一项重要民事权利 ,而我国《民法通则》及相关司法解释却将对隐私权的保护纳入对名誉权的保护范畴之内 ,这无疑对隐私权的法律保护十分不力。为此 ,笔者在对隐私和隐私权几个基本观点的简略论述之后 ,从我国的立法现状出发 ,指出现行法律规定的不足 。
The Right of Privacy is an independent right concerned with human dignity and enjoyed by any people.With the development of the society,it has become an important civil right of every person.However,the General Rules of Civil Law and the judicial interpretation concerned have brought the protection within that of the Right of Reputation.Thus its legal protection has been weakened.Therefore,after a brief introduction of several basic viewpoints on privacy and Right of Privacy,this paper,according to the analysis of the present legislation,points out the deficiency of the present legal protection over Right of Privacy and suggests some relevant measures for its perfection.
