摘要
空间权分为空间所有权与空间利用权。我国土地公有的性质决定了空间所有权只能是公有 ,一般主体取得的只是空间利用权。作为空间权的标的 ,“空间”范围仅指在附属于地上权空间之外的由国家或集体所有的空间。地上权人对自己土地一定上下空间的使用 ,是地上权的当然附属部分 ,不能作为独立的空间权的标的。此理论为我国正在起草的物权法应如何规范空间权提出了参考性设计思路。
Space Rights include the Ownership of Space and the Use Rights of Space. Ownership of Space in China must be state-owned based on the state-owned land, so that the general subjects can only have the Use Rights of Space. As the objective of Space Rights, space refers only to the one owned by state and collective, not including the space subordinated to the Use Rights of Land. Based on the above conclusion, we goes further to study the feature of Contiguous Rights of Space and the ways to protect this kind of Rights. Lastly, we present practical ideas by the designs of the concrete legal articles of the future Property Law.
