摘要
保辜制度是中国刑法史上的一项重要制度 ,惜乎法史学界探讨很少。本文主要从保辜制度的演进、概念及其类型、立法基础等方面对它进行论述 。
The system of grace allowed to offenders for the purpose of awaiting their repentance shown and efforts made to rescue the wounded or the dying on which to base the measurement of penalty is an important system in ancient China.In this paper is made an account of its concept,evolution,types,and legislative basis.
