摘要
中、德两国刑法都规定了污染环境犯罪以惩治污染行为。但“两法”在其法律规定模式与犯罪构成方面有所不同。我国大陆刑法应在相关方面完善污染环境犯罪。
Both Chinese and German criminal laws stipulate crime against environmental pollution to punish it But the two laws are different on the aspects of legislative models and constituents of crime of environmental pollution. The related stipulation of environmental pollution crime should be improved in Chinese criminal law.
