摘要
犯罪主体是犯罪构成的四大要件之一。对犯罪主体概念的界定既是理论的需要,又是司法实践的需要。本文结合刑事实体法理论与我国刑法的规定和司法实践,在对传统的犯罪主体概念进行反思的基础上尝试性地重构了犯罪主体的新概念。
