摘要
概述了国际货物买卖中知识产权担保的含义及商标“反向假冒”的构成要件 ,针对目前我国关于商标“反向假冒”立法中存在的问题 ,参照国外立法的先进经验 ,提出了我国在今后的立法工作中应重点增加知识产权保护条款的建议。
This paper sketches the meaning of intellectual property guarantees in international trade of cargo and the important conditions forming 'inverted imitation' of trademark. In the light of the problems existing in China's legislation of 'inverted imitation' of trade mark and referring to the advanced experiences of foreign countries' legislation, this paper puts forward the suggestion of adding the clause of intellectual property protection emphatically in the future legislation of our country.
