摘要
因输注血液及其相关制品导致受血者感染病毒以及由此引发的血液安全责任与赔偿,是当前关乎公共安全与健康的一个重要问题。文章回顾分析了西方主要国家输血后感染HIV事件的因果,及其由此而建立完善的血液安全管理制度及无过错赔偿方案的司法实践。作者提出:西方国家的经验对我国的血液安全及责任、赔偿制度的建立与完善可提供有益的借鉴。
One top issue of public security and health at the moment is the viral infections due to blood transfusion and use of blood products, and the blood security liability and compensation therefrom. This article reviews the causes and effects of HIV infection due to blood transfusion in the western countries. It also covers the perfect system of administration over blood security and judicial practice of non - fault and compensation program. The author proposes that we should use experience of the western countries for refer-ence in establishing and improving the blood security liability and compensation system in our country.
