摘要
伴随着人口老龄化时代的到来,老年人的犯罪与刑罚问题已成为我国当前理论界与实务界的热点话题。我国现行法律对此虽有所规定,但仍有许多需要完善的地方。从《唐律疏议》中有关老年人犯罪的立法规定着手,具体分析有关老年人犯罪的宽宥制度,并对这种制度进行深度分析,以期能够为我国现行法律的完善带来一定的启发,并促进我国刑事法制建设的良性发展。
:With the advent of the aging era,the crime and punishment of the elderly have become topics so much talked about both in theory and in practice.Although current laws in China have relevant provisions,a great deal still needs to be done.This paper first referred to provisions on crimes of the elderly in The Tang Code,and then analyzed the leniency policy applied to older adults,with the hope of improving the existing laws in China and promoting the sound development of criminal law construction in China.
