摘要
知识产权作为一种无形的财产权 ,是智力劳动者对其创新性的成果依法享有的一种权利。知识产权制度是各国政府保护智力劳动成果的一种法律保障制度 ,即该制度通过法定程序和条件授予智力劳动成果完成人在一定期限内对其知识产权拥有的独占权 ,并以法律手段保障这一权利不受侵犯。在当今的国际经济贸易中 ,知识产权保护涉及的领域在逐渐加宽 ,份量也在逐渐加大。在未来的国际贸易竞争中 ,知识产权将是国际经济及科技竞争的焦点。中国已经加入 WTO,面对日益开放的商品农产品市场和农业科技市场 ,如何做好农业知识产权的保护工作 ,并提高中国农业及其相关产业的国际竞争能力 ,将是一个值得认真思考的问题。
As a kind of property right,the intellectual property right of agriculture is the right which the agricultural scientist and technologist have,according to the related laws,based on their innnovative achievements in their agricultural research work.China will enter WTO in near future,but China has no established the effective protecting system and according policies,on the basis of the WTO'regulations and the international conventions,of intellectual property right of agriculture.Therefore,this paper thinks it is a problem that establishing efficient protecting system of intellectual property tright of agriculture we need to discuss and research so as to strengthen the protecting ability of intellectual property right in agriculture after entry WTO.
