摘要
点警制是新生制度 ,目的为提高办案效率 ,却混淆了权力与权利的界限。通过分析诉讼效率与诉讼公正之间的冲突关系 ,发现点选警察制没有根本性提高办案效率 ,反而加剧控辩力量失衡 ,一定程度上牺牲了程序正义。
The newly born 'system of selecting policemen' aims at raising the efficiency of handling cases, but it confuses the bounds of power and rights. Through the analysis of the conflict between lawsuit efficiency and justice, it has been found that, actually, the system can not raise the efficiency. On the contrary, it has exacerbated the unbalanced power contrast between accusers and defenders, which, in some degree, damages the procedure justice.
