摘要
物权法是否应当将承包经营权确认为一种物权 ,是目前物权立法首先需要解决的一个重大课题。土地承包经营权必须物权化 ,这样更有利于保护承包经营权人的利益 ,稳定土地承包关系 ;而且土地承包经营权物权化能够使土地承包经营权具有对抗第三人的效力 ,还可以更有效地促进土地承包经营权的流转。关于承包经营权的转让方式值得深入探讨。需要指出的是 。
Whether or not the law of property right should identify contractual operation right as a kind of property right is a major subject that badly needs to be solved by current property right legislation. Contractual operation right of land must be included as property right so as to better protect the interests of the contractor, stabilize contractual relationship, and moreover to ensure the validity of contractual operation right of land against the third person. Besides, it also helps effectly promote the circulation of contractual operation of land. The contractual operation should be subject to the adjustment of the property right, and methods of transfer of contractual operation right are worth of studying in a deep going way.
