摘要
不同的法律部门有不同的法益目标 ,经济法的法益目标应是经济法首先追逐和实现的利益即社会公共利益。这种法益目标 ,以经济基本权为权利外形 ,以实现经济上的“公平”为核心。经济法的法益目标的社会根源 ,是经济法所调整的社会关系 ,它是以社会公共性为根本特征的经济管理关系。
Different legal branches have different legal interests. The legal interest of economic law focuses on the interest that economic law initially wants to realize, namely the social public interest. This interest's expression is the fundamental economic rights, and its core is to fulfill the equity . The social origin of this legal interest is the social relations regulated by economic law, whose basic character is social public. The realization of this legal interest relies on the function of general social regulatory system.
