摘要
电子商务的发展离不开电子商务立法。目前已有不少国家和地区已经制定了电子商务法 ,也有不少国家正在准备立法。缺乏对电子商务的法律规制已经成为制约我国电子商务发展的重要因素 ,因此 ,迫切需要进行电子商务立法。要制定出适合我国的电子商务法 ,离不开正确的立法指导思想与基本原则。在我国 ,进行电子商务立法必须遵循开放原则、协调原则、安全原则和鼓励、促进、引导等原则。
Electronic commercial affairs legislation is necessary for the development of electronic commercial affairs.Nowadays,not a few countries and districts have made electronic commercial affairs laws and,more and more countries prepare for it.Lack of imposing legislative restriction on electronic commercial affairs has become a significant factor of conditioning electronic commercial affairs advance of China.Therefore,we are badly in need of making electronic commercial affairs laws. To make electronic commercial affairs laws adaptable to China,we must determine reasonable legislative guiding ideology and principles.In China,we must follow the principles of opening to the world,the harmonizying,safe,ercouraging,promoting and guiding principles,when we carry out the electronic commercial affairs laws.
