摘要
基因专利的法律保护面临挑战。从基因生物学含义的角度来看，基因符合"新颖性"、"创造性"、"实用性"的三性要求，属于专利保护范围。分析国内外现有的观点和做法，本文认为我国完全应该和可能对基因提出专利法律保护。
The legal protection of gene patent is confronted with challenges. From the angle of biological conception ,gene conforms to the all requirements of 'novelty ','inventiveness'and 'utility',and falls within the scope of patent protect ion. After an analysis of the current view and practice at home and abroad,this paper concludes that China should provide legal protection in the case of gene patent .
