摘要
人民法院提起民事再审程序使民事再审程序的公正性蒙上阴影。民事再审程序应由人民检察院提起 ,真正实现审判监督程序的纠错功能。
The civil retrial procedure instituted by the people's court is one of the ways of starting up the procedure.The irrationality of the way,however,clouds the impartiality of the civil retrial procedure.The procedure should instituted by the people's procuratorate to really realize the function of correcting mistakes in the trial supervision procedure.
