摘要
法律移植是世界法律发展中的一个常见现象。从法律移植对于法律形式化、法律价值理念的现代化和法律的效益化三者的推动出发，可以看到法律移植对于法制现代化的积极意义。法制现代化是当代中国移植外国法律制度的价值目标。
Legal system transfer is a common phenomenon in the development of the legal system in the world. From the point of view that legal system transfer can promote legal formalization, modernization of legal value con- cepts, and legal profit, it is clear that legal system transfer is significant to the modernization of legal system. And the modernization of legal system is the aim of China's transferring foreign legal system.
