摘要
经过对大陆法系公私法划分理论的标准、争议的评述 ,分析中国历史及现实中存在的公私法划分现象 ,为这种划分是一个从历史理念到现代理论的演变过程。现在重提公私法划分 ,是通过对大陆法系公私法划分理论的移植 ,适应市场经济的需要所作出的理性选择 。
By comprehensive demonstration about the division of the public and private law,this paper analyzes this division in Chinese history and reality.The division is a developing course from the ideal to the theory and it is a theoretic transplant and a reason choice in the market economy,therefore it is more important today.
