摘要
宪法具有司法适用性 ,已成为当代宪法发展的重要趋势之一。但是 ,在我国 ,由于认识上的偏差、理论研究的缺失以及不适当的司法解释 ,学术界和司法界普遍认为我国宪法不具有司法适用性。本文认为 ,作为对当代宪法发展趋势的积极回应 ,我国宪法应当具有司法适用性 ,并且我国宪法司法适用性具有法律的、实践的充分依据。
The judicial application of constitution has become one of the important trend of contemporary constitutional development. But in Chinese academic circles and the bar, as the deviation of cognition, the defection of theoretical study and inadequate judicial interpretation, It is commonly thought that Chinese constitution can't be applicable in judicial action. The essay holds that Chinese constitution can be applicable in judicial action in coincidence with the trend of contemporary constitutional development, and that the judicial application of Chinese constitution has sufficient legal and practical basis.
