摘要
迁徙自由权是现代社会公民应当享有的一项基本宪法自由权 ,也是现代文明社会的一项基本人权 ,正是因为迁徙自由权具有宪法权利属性 ,世界各国宪法和国际人权公约中都有关于迁徙自由权的保障与限制性规定。根据当代中国走向社会主义市场经济的现实要求 ,在我国恢复宪法迁徙自由权具有重要意义与价值 ,应当提出确立宪法迁徙自由权的修宪建议。
The freedom of migration is essentially the constituti on -bestowed right to the citizens in our modern society; it is also the basic hum an right the citizens enjoy in a civilized world. The constitution property of m igration freedom results in the fact that migration freedom is guaranteed and stipulated, with some restrictions, in every constitution all over the world, an d even in the International Human Right Treaty. As it is the case that China is in the process of developing its socialist economic market, the realistic demand makes it extremely significant and valuable to bring back the migration freedom in the constitution. Thus, proposals should be stated to make certain revisions in this aspect in the constitution.
