摘要
环境污染或破坏所致的企业和所在地居民间的纠纷以及过激冲突行为 ,需要寻求能在常规上解决问题的途径和方法。创设环境自卫权以“私力救济”无疑具有不可替代的作用。本文就环境自卫权的生成原因、界定。
Disputes and Conflicts between enterprises and residents in the neighbourhood are frequently caused by environmental pollution and destruction. We should seek an effecfive solution to them. The author thinks it is very important to creat Environmental Self-defence Right which means to solve the pollution problems by private force. This paper makes a preliminary research on the origin, definition, constituation and realization of the Environmental Self-defence Right.
