摘要
封建时代的慎刑思想由来已久,自汉代以降形成的"德主刑辅"绵亘至唐律,逐渐演变成宽仁的量刑指导思想。基于这一指导思想,唐律中的量刑制度完成了从"无序化与重刑化"到"统一化与宽缓化"的转变。量刑宽缓化的核心在于"务在恤刑,量刑从宽"和"宽严俱平、诉求公允",而量刑统一化的要义在"权衡轻重,同符画一"和"明正赏罚,一断以律"。为此,唐律中量刑基准等之建构,首开人类量刑精确化先河,在量刑制度史上占有独特的地位。
Feudalism cautious punishment thought has a long history.The ' morality guiding and punishment supplementing',which has been formed since Han Dynasty has gradually developed to the guiding ideology of ' tolerant and benevolent sentencing' in Tang Dynasty.Based on this guiding ideology,Tang Dynasty's sentencing system has realized the transformation from ' disorder and penalty heavily ' to ' unification and relief'.The core of the relieved sentence is 'devoting to sentencing cautiously,sentencing leniently' and 'tolerating and chastising impartially,appearing fairly'.The main idea of the unified sentencing is 'weighing up the matter carefully,integrating standards of sentencing' and 'rewarding and punishing explicidy,appealing fair and just'.Therefore,viewing from the establishment of the sentencing criterion and so on,Tang Dynasty has pioneered the standardized sentencing in human history,and played a unique role in the history of sentencing system.
