摘要
通过对黑龙江等地方民族民间传统文化的研究发现,虽然我国民族民间传统文化资源丰富,但是却面临着国家立法空白,法律保护衰退的问题。在探寻民族民间传统文化内涵外延和法律保护现状的基础上,得出对民族民间传统文化的法律保护要重点采取私法保护的模式,特别是以著作权保护和商标权保护为核心的知识产权法保护模式。
Through studying traditional folk culture of Heilongjiang province,although our country has abundant and diversified traditional folk culture resources,legislation for protecting traditional culture is still absence,as well as recession in legal protection. On the basis of exploring the connotation and denotation of traditional folk culture and current protecting situation,we should implement private laws to protect traditional folk culture,espe-cially protecting intellectual property rights( IpR)with copyright and trade mark right as its core.
