摘要
本文主要利用文献检索法、访谈法,从竞技体育"举国体制"背景下青少年运动员文化教育的现状出发,探讨当前运动员在训练的同时又作为在校学生,其受教育程度严重非理性弱化的表现和后果,理论分析了这一现象产生的社会原因和法治根源,并最终从教育法角度探讨了其受教育权得以回归的法制途径,笔者认为对在校运动员受教育权法治保障的关键在于教育理念的回归和教育申诉制度的建立。
After the interviews and literature analysis, This paper first discusses the current situation of athletes'educational situation under the "nationwide system"of competitive sports, and then discusses about the manifestation and consequence of the deviation happened between the training mode of current athletes and their rights of education. The writer analyses the social and legal reasons , and finally discusses how to protect the athletes' rights of education by law.
