摘要
在立法迈向"后体系时代"的背景下,立法学研究所凸显出的研究转向与研究之嬗变,需要我们认真考察。立法学嬗变的动因在于法律体系向法治体系转变过程中的理论诉求,具体包括法律创制转向法律实施、宏观法治转向微观法治两个方面的理论诉求;立法学嬗变的走向是从立法原理的认识论、立法价值的价值论、立法制度设计的本体论转向以立法技术为中心的方法论研究;立法技术主要由包括形式结构规范技术、实质结构规范技术的立法表达技术与以立法前评估、立法后评估为主要内容的立法评价技术构成。
When the legislation moves into the Post-system era, we need to seriously examine the ori- entation change and evolution in legislative research. The evolution of legislation study is caused by theo- retical demands in the transformation process from the legal system to nomocracy system, specifically in- eluding two aspects ： lawmaking turning to law enforcement and macro nomocracy turning to micro nomoc- racy. The evolution of legislation study will move towards methodology research which centering on the legislation technology from epistemology of legislation principle, value theory of legislation value and on- tology of legislative system design. Legislation technology is mainly consisted of legislative expression technology and legislative evaluation technology. Legislative expression technology includes formal struc- ture specification technology and essential structure specification technology. Legislative evaluation tech- nology includes evaluation before legislation and evaluation after legislation.
