摘要
律师在场权在刑事司法中具有重要价值,许多国家都对此有所规定。目前我国全面推行律师在场权制度尚存在一些障碍,因此可以考虑首先在一些不增加司法投入,不影响侦查效果的场合确立律师在场权,然后再随着条件的具备用渐进的方式推进,最终在刑事诉讼中构建全面的律师在场权,完善对被追诉人权利的保护。
A counsel＇s presence right in criminal justice is of great value,and many countries have formed regulations on this subject.However,in China there are still some obstacles in full implementation of counsels＇ presence right system.This paper proposes its progressive construction to protect the rights of the accused：first,ensure counsels＇ presence right if judicial input is not increased and the investigation results are not affected;secondly,progressively construct counsels＇ presence right system in criminal justice as conditions are improved.
