摘要
"舆论参与司法"是转型中国一种突出的司法景观,究其深层次机理,实为当下中国社会回应转型的一种独特形式,亦是民众政治参与的一种重要渠道,可谓政治参与和司法民主的结合。其实施路径是通过对司法个案的参与,达到参与政治社会制度层面的结果。这一景观的产生有深刻的时代烙印,与中国社会转型期的国情紧密相关。它以"公平、正义"为主题,以常识、价值取向和法律为基础,形成了一个商谈性的公共领域,一定程度上解决了当前社会转型期政治参与的困境,对于建设法治中国及公民社会有重要意义。当然,其错位与越界的负面影响也应给予足够重视和有效防范。
＂Public opinion participation in justice＂ is a prominent legal vision in China during the transformation stage. Its deep mechanism is a unique form of response to social transformation, and an important channel for political par- ticipation by the public, so it is considered as the combination of political participation and justice democracy. Its realiza- tion path is to achieve participation in political and social institutions through participation. This vision has its profound his- torical imprint, and is closely related to China＇s situation during tile social transformation. It takes ＂fairness and justice＂ as the theme, and takes common sense, values ？？ and law as basis, so as to form a consultation-based public sphere, which, to a certain extent, help resolve the dilemma of political participation during the current social transformation. It is impor- tant significance to the building of rule of law and civil society in China. Of course, the negative effects caused by its dislo- cation and cross-border practice should be given adequate attention and effective prevention.
