摘要
关于土地先买权,学界已多有研究,但还存在一些值得商榷之处。这主要体现在土地先买权对宗族发展的影响、它是否有利于土地经营管理、能否被视为乡族对私人土地拥有部分所有权、能否损害出卖人利益等四个方面。由此入手,在整理文献资料和总结各家观点的基础上可以认为:土地先买权对宗族发展并无太大影响;有利于经营管理的说法应区别对待;它不能被认为是乡族对私人土地拥有部分所有权;也不能损害到出卖人的利益。希望以此引起更多的争鸣。
There are many researches on the preemption of the relatives and family in the academic circles. However, there are still some problems worth discussing which are mainly in four aspects--the effects on the development of the clan made by the land preemption, whether the preemption is in favor of the management of the lands,whether preemption can be taken as the partial ownership of the private lands by the clan, as well as whether it is harmful to the seller＇s interests. On the basis of the research on previous documenta- tion and various perspectives, it is concluded that the lands＂ preemption has little effect on the development of the clan and is helpful to management, which be seen differently in different cases. It cannot be viewed as embodiment of the clan＇s partial ownership of the private lands, and also cannot damage the seller＇s interests. It is hoped that the paper causes more contention.
